Additional evidence -- Application for additional evidence, which was filed for examination of a Hand-writing Expert to compare the writing on the body of the cheque, which has been asserted by the petitioner to have not been written by him does not have any material significance especially when the signatures on the cheque have been admitted by the petitioner.

Denial of signature – Acquittal of accused -- Once the accused did not accept his signatures on the cheque, complainant did not make any effort to get the signature of the accused proved by examining any handwriting and fingerprint expert, it can be safely concluded that the learned trial court committed no error of law, while passing the acquittal order.

Signature on cheque – Cheque in question was dishonoured with the remarks “funds insufficient' – Accused has not examined an officer from her bank to prove that the bank officer did not verify signatures on the cheque – In absence of any plea by the accused during cross-examination of the complainant that the cheque does not bear her signatures and evidence of her banker that signatures on the cheque being not verified at the time of return of cheque with the remarks 'funds insufficient', there is no error in the order passed by the trial Court declining the prayer for examination of signature of accused on cheque by an expert.
